Part of a broader package of bills concerned with pay discrimination, including the Lilly Ledbetter Act (passed in 2009) and the Fair Pay Act, the Paycheck Fairness Act has been introduced in every congress starting in the 105th Congress (1997-1998) and was passed by the House in 2009 with 200 co-sponsors. The goal of the bill is to narrow the pay gap between men and women by restricting the employer defenses in the Equal Pay Act and eliminating caps on damages resulting from pay discrimination lawsuits.

The proposed legislation for the “Paycheck Fairness Act” would amend the Equal Pay Act to eliminate some potential loopholes and clarify the circumstances under which employers could differentiate pay levels among employees.

The Paycheck Fairness Act was defeated in the Senate in the 111th Congress.
